Where you have child welfare concerns, where abuse of children is suspected, your first stop must be the Police, or Government child welfare agencies. They have greater powers to access information, and conduct interviews, than a private investigator. Where the suspicion is part of a Family Law action, a child custody application, or a child access application, they are often reticent to become involved without evidence.
Where allegations are raised, as part of a Family Law action, without evidence, they cannot be actioned, generally. The court has a problem with claims, and counter claims, as two sides attempt to improve their position. The focus of the court is the rights, and welfare of the children, and the evidence presented. A private investigator is used to gather evidence, to confirm or deny a suspicion, to verify a claim.
The role of the private investigator is the gathering of evidence to support, or contest, a position. We are a disinterested party, and can only gather the evidence we locate. The role of the solicitor is the preparation, and presentation of the case, the supporting evidence, and the use of case law. They may also present rebuttal evidence, to counter a claim of opposing counsel.
The weight given to evidence may rest on the truthfulness of the witness. Where deception of the court can be established, the weight of the evidence given by that person is diminished. In a contested Family Law matter this is important.
