A real WorkSafe investigation, WorkSafe investigator attendance, is generally related to an incident, or accident, where a breach of the prescribed legislation has occurred, or a person was injured or killed in a workplace. There is a requirement to facilitate the investigation, as the whole site may be 'seized' by the investigations team. These investigations are concerned with Health and Safety, Dangerous Goods compliance, High Risk operations, and rehabilitation. A WorkSafe investigation is a Health and Safety investigation, looking into contributing factors, causes, for a death or serious injury. It often appears to have the objective of assigning blame to a business, or persons associated with the business, such as supervisors. It looks at events (including near misses), training, inductions, procedures, and compliance with same (including enforcement, within the business, of compliance, not turning a 'blind eye').
Before a 'WorkSafe investigator' (more correctly a WorkCover investigator, an insurance investigator) gets involved, generally, once a claim is accepted, the employer must raise a reasonable belief (with proof), of fraud. The reason for this is that, once the WorkCover claim is accepted by the insurer they basically become a rehabilitation coordinator. Once a claim is accepted the insurance provider requires more than a suspicion to change their stance. The employer, the business, must reach the civil standard of a reasonable suspicion, through evidence.
