Something is lawful when it is authorised, justified, or excused by law. Surveillance by a licensed private investigator is authorised, as one of the authorities granted by their licence.
Private investigator surveillance is a way of confirming a fact, or verifying a suspicion. Employing a private investigator surveillance operative is legal.

Surveillance Evidence
Surveillance evidence generally consists of the operatives surveillance journal (their notes), and the supporting footage, or still images. This is evidence.
Only a person can give evidence, the media is supporting the evidence of the private investigator, their observations. This journal, and image evidence, may become an annexure to an affidavit, for court purposes.
