Elder abuse has become a sad part of life, as our population ages, lives longer. Signs of elder abuse include an unkempt appearance, injuries and broken bones, isolation, theft of monies and sale of assets (including by relatives), a carer who becomes the 'married' partner just before a death, changed wills, and suspect beneficiaries, an unexpected death.
The line between family, gifts, and elder abuse can become blurred, where a 'senile old bugger' gives everything away, and family step in to preserve the assets for themselves. That a person chooses to dispose of their assets, whilst they are alive, is their choice. If the person is no longer of a firm mind, it may not be their free choice, that becomes the issue.
Occasionally there is an opportunity to use surveillance to show elder abuse, this is less common that factual investigations. There are times when, to investigate abuse in an institution, you have to break the law, because putting surveillance in the room of a person being abused in an institution, including an 'old people's home', who may not be able to give evidence themselves, may be illegal, but it may also prove what you suspect. Very rarely do the Police take the correct action, and obtain a warrant for surveillance to investigate institutional elder abuse. Unfortunately we cannot put our private investigator's licence at risk to install 'illegal' video recording devices (usually set to motion activation, with audio), we can tell you what to do, and will advise you it is illegal. You can make your own decision. It is up to a court if they will allow it to be entered as evidence. Of course any action to prove you illegally installed the device will require that the video evidence be played to a court to prove the offence (I'd ask for it all to be played, and admitted), and once entered into evidence it may be used for other actions (not saying this is a way to get it in, but).
Sometimes the actions required to prove elder abuse, especially in a nursing home, are illegal under the Privacy Act, but necessary to prove elder abuse, a failure to provide the care that is obliged. A more common one has become the younger carer (often female), who starts as a carer of a much older male, convinces him they're 'in love', marries him, and pockets the assets, when he dies shortly thereafter. There are less common examples of a male carer doing this, but either can occur.
Occasionally the first the family, who have been isolated from the dying person, since the carer became involved, only become aware of the claimed marriage, after the death.
